What is a Section 1115 Demonstration Waiver?
Section 1115 waivers provide states an avenue to innovate and test new approaches to provide health care. These waivers are typically designed to demonstrate how changes to program requirements can be used to improve access to care, increase efficiencies, or lower costs without increasing federal Medicaid expenditures. Examples of the types of flexibilities states may seek to test with an 1115 waiver include:
- Expanding eligibility to individuals who are not otherwise Medicaid or CHIP eligible
- Providing services not otherwise covered by the state’s Medicaid program or federal law
- Utilizing new and innovative service delivery systems for providing services in Medicaid
How to Weigh in on These Changes
Prior to applying for a new 1115 waiver demonstration, states must publish public notice and conduct two public hearings within a public comment period of at least 30 days.
