Waiver for Individuals with Intellectual Disabilities and Related Conditions Renewal Application to CMS

The Waiver for Individuals with Intellectual Disabilities and Related Conditions will expire on September 30, 2018. The Division of Health Care Financing and Policy (DHCFP) must submit the Home and Community Based Services (HCBS) Waiver renewal to the Centers for Medicare and Medicaid Services (CMS) no later than June 30,2018.

 

Services under this waiver will remain the same, however, there is a new direction in accordance with CMS Final Rule. The Final Rule ensures a focus on person centered planning, individual's rights of privacy, dignity, respect, freedom from restraint, optimize the individuals' initiative and autonomy, community inclusion, engage in community life, the opportunity to seek employment and work in competitive integrated settings. The new CMS rules for Home and Community Based Settings have been updated to ensure the states compliance with the Final Rule. The Aging and Disability Services Division (ADSD), the operating agency, has begun implementing features of the Final Rule in their business practices.

 

The CMS requires that states obtain public input for a waiver renewal in accordance with 42 CFR 441.304(f). The DHCFP requests public comment regarding the waiver renewal.
